The general terms and conditions of sale define the terms and conditions under which the customer orders and purchases products sold by the company “Les Succès du Pilat”, as part of a remote sales system on the internet, for products available for sale on the website sucettegoutbite.fr.

The site /sucettegoutbite.fr is the exclusive property of SAS “Les Succès du Pilat”, as well as all related rights. As such, any partial or total reproduction of the texts or photos is prohibited unless prior written consent is obtained. Hyperlinks to the website sucettegoutbite.fr must be approved by SAS “Les Succès du Pilat” before installation.

Any order placed for a product listed in the online store on the sucettegoutbite.fr site requires prior consultation and full, unconditional acceptance of these general terms and conditions of sale.

As a result, the consumer acknowledges that their agreement concerning the content of these general terms and conditions does not require the handwritten signature of this document, as long as the customer wishes to order products online presented on the sucettegoutbite.fr website.

SAS “Les Succès du Pilat” reserves the right to modify the General Terms and Conditions of Sale at any time and encourages its customers to consult them regularly.

Products:

1 – The photographs and descriptions of the products offered for sale aim to describe our sweets as accurately as possible. However, they are provided for informational purposes and do not form part of the contract. Therefore, while represented on the site with the utmost precision, the photos and texts may contain errors. In this case, the liability of SAS “Les Succès du Pilat” cannot be engaged.

2- SAS “Les Succès du Pilat” presents the products for sale on its website with the necessary characteristics to comply with Article L 111-1 of the Consumer Code, which requires consumers to be informed of the essential characteristics of the products they wish to purchase before placing an order.

3 – All items listed on the site for sale are reserved for private individuals.

4 – We make every effort to ensure that all our products are flawless. However, if you encounter a specific issue, please contact our company at the following address: SAS Les Succès du Pilat 48 Boulevard d’Almandet 42220 Bourg Argental.

Availability:

All products visible in our online catalog are deliverable subject to availability. In case of stock shortages, SAS Les Succès du Pilat undertakes to inform the customer by phone or email as soon as possible to arrange for delivery once the product is restocked, when possible.

Shipping and Delivery:

This remote sale applies in mainland France, including Corsica, excluding Overseas departments and territories.

Upon confirmation of payment (approved by payment centers or receipt of the check), SAS “Les Succès du Pilat” will deliver all the ordered items to the carrier within 2 to 15 days, depending on the season and availability. These timeframes are strictly indicative and may be extended arbitrarily to ensure the product’s quality, especially during hot weather. The customer will be informed of the delivery date by the carrier.

Products can only be delivered to the delivery address provided by the customer during the order process. The information provided by the buyer at the time of the order is binding. In case of error in the recipient’s details, the seller is not responsible for any inability to deliver the product. Orders with a P.O. Box address cannot be processed.

Any delays in delivery (holiday periods, strikes, summer vacations, etc.) cannot result in damages or compensation.

If the goods, under the carrier’s responsibility, have not been delivered due to customs issues, strikes, damage, or any other force majeure cause as defined by the courts, the sale may be canceled, and the customer may receive a refund of the purchase price, excluding any other indemnities or compensation.

Delivery will be made by the mode of transport selected by the customer at the time of confirming the order. SAS “Les Succès du Pilat” reserves the right to adapt the delivery method based on the order. The customer is advised to check the condition of the package upon arrival.

In case of damage or missing items, you must, to request reimbursement for the goods:

  • Upon receipt, ensure the condition of the package and its compliance with the order in front of the carrier. In case of damage, incorrect delivery, or missing items, the customer must write and sign reserves on the delivery note. Without this clause, no claims will be accepted by SAS “Les Succès du Pilat”.
  • Any reserve must immediately be confirmed with SAS “Les Succès du Pilat” customer service, preferably by phone. Then, reserves or claims must be sent by registered mail with acknowledgment of receipt to SAS “Les Succès du Pilat” customer service within 7 days of receipt of the package to address the complaints. Failure to notify within this time frame will be deemed as the customer accepting their delivery and all the products in their order, preventing them from taking legal action against SAS “Les Succès du Pilat”. Likewise, late claims are not acceptable and will prevent any further claims.

Absence:

The selected service provider delivers throughout France and offers the possibility to collect ordered products from your post office or a “relay” establishment near the delivery address in case of absence on the day of delivery.

Specifically, if you are absent on the delivery day, the carrier will leave a delivery notice in your mailbox, via email or SMS, allowing you to pick up your package from the post office or relay establishment during working hours or to contact them to schedule a new delivery.

Due to the fragility of our products, SAS “Les Succès du Pilat” cannot guarantee the product’s quality if it is picked up more than 48 hours after being held at the transporter’s office.

These services are highly reliable. However, as with any shipment, delays or lost products may occur. In case of a delivery delay compared to the indicated shipping date, please inform us by phone or email, and we will initiate an investigation with the service provider. An investigation may last up to 21 days from the start date. If the product is found during this period, it will be immediately redirected to your home. If the product is not found within the 21-day period, the provider will consider the package lost. At that point, we may send a replacement product at our expense, or if the product is no longer available, we will refund the cost of the lost items.

Protection of Minors:

Minors are not capable of contracting, and all data must be submitted with parental consent, which may oppose its retention and/or transmission to third parties.

Prices:

The prices of the products listed on the website are in Euro (€), including VAT (all taxes included), excluding packaging and shipping costs.

Billing is based on the rate applicable at the time of the order, considering the VAT applicable to the ordered product. If VAT rates change, these changes will be reflected in the sale price of the items and sales documents without prior notice. Prices may change without notice.

The cost of packaging and shipping will be added to the price of the goods and will be displayed before order confirmation. Delivery fees are fixed, regardless of the order’s weight.

The full payment of the price must be made at the time of the order. Under no circumstances will the amounts paid be considered as deposits or advances.

The total invoice amount, including taxes, in euros, includes the price of the products, packaging, and shipping costs. For any accepted order, SAS “Les Succès du Pilat” guarantees the rates applicable at the time of order confirmation.

Simply send us a check for the total order amount, including shipping fees. The check must be drawn from a bank in mainland France and made payable to SAS “Les Succès du Pilat.” The check should be sent to the following address: SAS Les Succès du Pilat, 48 Boulevard d’Almandet 42220 Bourg Argental. The order processing and shipping begin upon receipt of the check. The check will be processed upon receipt.

Please do not forget to include your order number when sending your payment.

However, SAS “Les Succès du Pilat” reserves the right to suspend any order processing and delivery in case of payment refusal from accredited organizations or in case of non-payment.

SAS “Les Succès du Pilat” reserves the right to refuse delivery or fulfill an order from a consumer who has not fully or partially paid for a previous order or is involved in an ongoing payment dispute.

Acceptance:

Acceptance by the customer of these terms is evidenced by ticking the box “I have read the general terms and conditions of sale and accept them without reservation,” as well as by providing their banking details or sending a check for payment of their order.

Order confirmation by the consumer constitutes an electronic signature that has the same value as a handwritten signature between the parties.

The order confirmation is confirmed by an email sent by SAS “Les Succès du Pilat.”

Warranties and Disputes:

SAS “Les Succès du Pilat” guarantees that the products are manufactured and packaged according to strict quality standards and stored according to French regulations.

Our customer service is available to resolve any disputes that may arise.

SAS “Les Succès du Pilat” undertakes to respond to all requests for information, to call back or write to the customer for any reason. If a quick solution is not possible, an acknowledgment of receipt will be sent to the customer.

However, SAS “Les Succès du Pilat” cannot extend its warranty on products if the customer has not respected the optimal storage conditions or has consumed products beyond the expiration date indicated on the packaging.

SAS “Les Succès du Pilat” cannot be held responsible for damages of any kind, whether material, immaterial, or bodily, resulting from misuse or any interaction between the products and an external element, particularly due to improper storage or abnormal use of the products.

Applicable Law:

This contract is governed by French law and limited to mainland France. The language of this contract is French.

The St Etienne (Loire) court will have exclusive jurisdiction for any disputes or disagreements between the customer and SAS “Les Succès du Pilat.”

Data Privacy:

By ordering through the online store www.fabrique-julien.fr, the customer consents to the use of their personal data by SAS “Les Succès du Pilat.” This data is necessary for processing orders.

At no time will SAS “Les Succès du Pilat” have access to confidential payment information (card number, expiration date). Banking details will be requested with each new order.

All this information is processed with the utmost care and discretion. The file containing this information has been declared to the Commission Nationale de l’Informatique et des Libertés under number 1468252.
